A group of voters, headed by rural Gaylord resident  and petitioner Nathan Kranz, have filed a lawsuit in Sibley County District Court to contest the recent passage of the Sibley East Public Schools $43 million building bond referendum.
Voters in the Sibley East School District approved the building bond referendum 1,634-1,538 during a special election on Tuesday, Nov. 4.
Kranz contests the bond issue special election on two grounds, according to the court document.
First, the School District, acting through the clerk of the School District, failed to publish the notice of the ballot question two weeks prior to the Nov. 4 election as mandated under Minnesota Statute 205A.07.
Second, the School District, acting through the School Board, failed to timely publish an adequate notice of the Minnesota Department of Education Commissioner’s review and summary of the projet(s) supported by the ballot bond question placed before the voters on Nov. 4 as mandated under Minnesota Statute 1233B.71, Subdivision 12.
