The Arlington Planning & Zoning Committee will hold a public hearing on Thursday, June 6, 2019, at 7:05 p.m. or as soon thereafter, in the City Hall Council Chambers, 204 Shamrock Drive to consider the following matter that requires a public hearing.

PURPOSE
To review and consider an application for a variance to the street side (corner lot) yard setback in the R-2 Single and Two Family Residential District. The variance would allow for placement of a deck in the corner side yard 13 feet from the property line. The required setback under Chapter 31, Section 8, Subd. 4(B)(2) of the City Code is 15 feet.
To consider a variance from City Code Chapter 17.03(A) and (C) pertaining to fences in front and street side corner yards. The City Code prohibits fences in front and street side corner yards.
Legal: Lot 1-3 EX W 10,’ Block 2, Hillman’s Addition, City of Arlington, Sibley County MN. Parcel #31.0388.000.

ORDINANCE NO. 325
THE CITY COUNCIL OF THE CITY OF ARLINGTON, MINNESOTA TO PROMOTE THE PUBLIC SAFETY, HEALTH AND WELFARE, HEREBY ORDAIN AS FOLLOWS:
AN INTERIM ORDINANCE
ESTABLISHING A
MORATORIUM ON THE
RESIDENCY OF PREDATORY OFFENDERS WITHIN THE CITY LIMITS.
The City Council finds the following:
1. The City has the authority under Minnesota Statute 462.355, Subdivision 4 to impose a temporary moratorium on certain uses within the city, pending study of an issue, before enacting long-term official controls.
2. Risk Level III predatory sex offenders as defined under Minnesota Statute 244.052 are shown by statistical studies to have a high risk of re-offense. The location of such individuals within city limits therefore present a significant threat to public safety, especially to children and vulnerable adults.
3. As a temporary regulation, the city declares it is unlawful for any Risk Level III predatory sex offender to establish a permanent or temporary residence within a 2,000 foot radius of any school, licensed child-care facility, public playground, school bus stops, group homes for vulnerable adults, or any other place where children or vulnerable adults are commonly known to congregate.
4. This moratorium shall be in effect for no more than one year from date of adoption. It is intended that the City Council refer this matter for study for appropriate city committees, to in turn make recommendations to the City Council to assist the Council in adopting long-term official controls, regulating residency options within the city limits for Risk Level III predatory sex offenders.
This ordinance shall become effective immediately upon publication.

The meeting was called to order at 6:30 p.m. Members: Brian Brandt, Laura Reid, Sarah Ziegler, Missy Weber, Avery Grochow, and Jon Hazelwood were present.
APPROVAL OF AGENDA:  Member Reid moved, second by member Hazelwood, to approve the agenda.  The motion was approved by unanimous vote.
VISITOR COMMENTS: None
CONSENT AGENDA: Approval of Minutes-Recommend approval of the March 18, 2019, School Board Meeting Minutes and April 9, 2019 Special School Board Meeting Minutes. Personnel; Hiring: Jon Farber, full-time buildings and Grounds, Gaylord (12.00 per hour), Resignations: Stephanie Rodning, 7th grade volleyball, Todd Kettner, jr. high boys basketball. Approval of consent Agenda: Motion by Member Ziegler,  second by Member Weber, to approve the consent agenda. The motion was approved by unanimous vote.

Acknowledge the receipt of “Notice of Desire to Negotiate” written notice from Sibley East Education Minnesota for the purpose of negotiating a successor agreement for the 2019-2021 school years. Motion by Member Grochow, second by Member Reid to acknowledge the receipt of “Notice of Desire to Negotiate” written notice from Sibley East Education Minnesota for the purpose of negotiating a successor agreement for the 2019-2021 school years. The motion was approved by unanimous vote.

Approve the Restated Agreement of the Joint Powers Board for the Sibley County Children’s Collaborative. Motion by Member Ziegler, second by Member Weber to approve the Restated Agreement of the Joint Powers Board for the Sibley County Children’s Collaborative as presented. The motion was approved by unanimous vote.

Consider request by Eide Bailly to audit the financial statements of the governmental activities each major fund, and the aggregate remaining information of the district as of June 30, 2019, and for the year ended , and the related notes (or) consider the same for fiscal years 2019, 2020,2021. Motion by Member Grochow, second by Member Hazelwood to approve the request by Eide Bailly to audit financial statements for Sibley East Schools for fiscal year(s) 19, 20, 21. The motion was approved by unanimous vote.

Bills and Payments: Recommend approval of April 2019 bills totaling: $1,423,966.41. Motion by Member  Reid, seconded by Member Hazelwood, to approve the April 2019 bills and payments totaling $1,423,966.41. The motion was approved by unanimous vote.
Consideration of further adjustments to the 2018-2019 School Calendar. Motion by Member Grochow, second by Member Weber, to apply to the State for 1 day of educational credit due to weather cancellations. The motion was approved by unanimous vote. Members Brandt and Hazelwood abstained from voting
Accept donation in the amount of : $2,235.00 Wolverine Track & Field Club- Track, $250.00 Trinity & St. Pauls Outreach Fund-Band, $25.00 Ashley Russell, YourCause LLC trustee for Accenture LLP- General purposes, $300.00 Green Isle Fire Dept. Gambling Fund-Trap team, $500.00 Green Isle Lions Club-Trap team, $500.00 Conservation Partner of America-Trap team, $1000.00 VFW Post 6031 Gambling Fund-Trap team, $100.00 Ashley Russell, YourCause LLC trustee for Accenture LLP-Band,  Motion by Member Weber, seconded by Member Hazelwood to accept the donations as listed. SCHOOL BOARD COMMITTEE REPORTS: None
SUPERINTENDENT AND PRINCIPAL REPORTS: Principals MariLu Martens and Steve Harter addressed the Board concerning recent and upcoming events at the school sites. Superintendent Jim Amsden updated the Board on upcoming meetings and topic areas.
OTHER INFORMATION: Reminder: Next Regular School Board Meeting is scheduled for May 20, 2019 beginning at 5:00 p.m. Media Center, Arlington Campus.
(Spring Fling Music Concert). Motion by Member Grochow, second by Member Reid, to      adjourn the meeting.  The motion was approved by unanimous vote.
